Court of Appeal upheld the provisions of section 45(5) and (6) of the Strata Titles Act 1985 which clearly provide that both the registered proprietor of a unit as well as any purchaser, who is to be duly registered as a proprietor, may be held liable for a debt arising as a consequence of a failure to pay management fees due and owing.
