This decision by the Federal Court is mainly two (2) fold, as it reflects the fact that all or any decisions made by any Public Body must be supported by “reasons” and the courts are of the opinion that an absence of such ‘reasons’ is unacceptable.
The 2nd factor is that when a body making a decision that affects a persons rights, by relying on a particular document or letter, then the person affected by the said decision is entitled to receive a copy of the document, so that he is able to respond to the allegations contained therein. This is enshrined by the decision of the Federal Court which upheld the Decision of the High Court, in this case.
